These terms of use (the "Terms of Use" or "Terms") govern your access and use of the applications, websites, content, products and Services ("Platform") made available by AtriAiApps Technologies Private Limited ("Atri," "we," "us," or "our"), a company incorporated under the Companies Act, 2013 and having its registered office at 11th Floor, Prestige Tech Platina 2, Marathahall Gunjur Bangalore Karnataka India 560087.

PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THE PLATFORM. BY ACCESSING OR USING THE PLATFORM, YOU ("YOU" OR "USER") AGREE TO BE BOUND BY THESE TERMS OF USE, WHICH ESTABLISHES A CONTRACTUAL RELATIONSHIP BETWEEN YOU AND ATRI. IF YOU DISAGREE WITH ANY PART OF THE TERMS OF USE, THEN YOU MAY NOT USE OR ACCESS THE PLATFORM. THESE TERMS EXPRESSLY SUPERSEDE PRIOR AGREEMENTS OR ARRANGEMENTS WITH YOU. ATRI MAY IMMEDIATELY TERMINATE THESE TERMS OR ANY SERVICES WITH RESPECT TO YOU, OR GENERALLY CEASE OFFERING OR DENY ACCESS TO THE SERVICES OR ANY PORTION THEREOF, AT ANY TIME FOR ANY REASON. SUPPLEMENTAL TERMS MAY APPLY TO CERTAIN SERVICES, SUCH AS POLICIES FOR A PARTICULAR EVENT, ACTIVITY OR PROMOTION, AND SUCH SUPPLEMENTAL TERMS WILL BE DISCLOSED TO YOU IN CONNECTION WITH THE APPLICABLE SERVICES. SUPPLEMENTAL TERMS ARE IN ADDITION TO, AND SHALL BE DEEMED A PART OF, THE TERMS FOR THE PURPOSES OF THE APPLICABLE SERVICES. SUPPLEMENTAL TERMS SHALL PREVAIL OVER THESE TERMS IN THE EVENT OF A CONFLICT WITH RESPECT TO THE APPLICABLE SERVICES. ATRI MAY AMEND THE TERMS RELATED TO THE SERVICES FROM TIME TO TIME. AMENDMENTS WILL BE EFFECTIVE UPON ATRI'S POSTING OF SUCH UPDATED TERMS AT THIS LOCATION OR THE AMENDED POLICIES OR SUPPLEMENTAL TERMS ON THE APPLICABLE SERVICE. YOUR CONTINUED ACCESS OR USE OF THE SERVICES AFTER SUCH POSTING CONSTITUTES YOUR CONSENT TO BE BOUND BY THE TERMS, AS AMENDED.

1. DEFINITIONS

In these Terms of Use, unless the context otherwise requires:

"AI Astrologer" means artificial intelligence-powered virtual astrology service provided through the Platform.

"Content" means all information, text, graphics, logos, images, audio clips, digital downloads, data compilations, software, and other materials available on the Platform.

"Human Astrologer" means any third-party individual service provider who is permitted to offer astrology-related consultations through the Platform on an independent contractor basis, where such individual is solely responsible for the content, accuracy, and delivery of their services, and shall not be deemed to be an employee, agent, partner, or representative of the Company for any purpose whatsoever.

"Personal Data" means any information relating to an identified or identifiable natural person as defined under applicable data protection laws.

"Services" means all astrology consultation services, features, and functionalities offered through the Platform, including both AI-powered and human astrologer consultations.

"Subscription" means any recurring payment plan opted by the User for accessing specified Services on the Platform for a defined period, subject to automatic renewal unless cancelled by the User.

"User Content" means any content, information, data, communication of any kind, including text, audio, video, images, messages or other materials, in any format that you post, upload, submit, or otherwise transmit to or through the Platform.

2. ACCEPTANCE AND CONTRACT FORMATION

By clicking "I Accept," registering or creating an account, or using the Platform, you acknowledge that (i) you have read, understood, and agree to be legally bound by these Terms of Use and our Privacy Policy, which is incorporated herein by reference. (ii) represent that you have the legal capacity to accept these Terms under applicable laws; and (iii) acknowledge that this agreement is formed electronically and is legally binding in accordance with the Information Technology Act, 2000 and rules thereunder and the electronic acceptance constitutes a valid, binding, and enforceable execution of this Agreement, with the same legal effect as a physical ink signature, under Applicable Law including the Information Technology Act, 2000.

Your electronic acceptance, as recorded by the Platform, shall constitute the "Effective Date" of this Agreement. A digital record of such acceptance shall be maintained by Atri and shall be admissible as evidence of User's agreement to these terms.

If you are accessing the Platform on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. ELIGIBILITY AND AGE REQUIREMENTS

Age Restriction: By using this Platform, you represent and warrant that you are at least 18 years of age or the age of majority in your jurisdiction of residence and are legally capable of entering into binding contracts under applicable laws. If you are under 18 years of age or below the age of majority in your jurisdiction of residence, you are strictly prohibited from using the Platform unless you have obtained verifiable parental or legal guardian consent.

Parental Consent: If you are between 13 and 18 years of age, you may only use the Platform with the express consent and supervision of your parent or legal guardian, who must agree to these Terms on your behalf and be responsible for your use of the Platform.

Age Verification: We reserve the right to request proof of age or parental consent at any time. Failure to provide such verification may result in immediate suspension or termination of your account.

Prohibition on Use by Minors: We reserve the right to terminate any account if we discover or have reason to believe that the user is under the required age without proper parental consent.

4. SERVICES DESCRIPTION

The Platform provides astrology-related services, including but not limited to:

  • AI-powered virtual astrology consultations
  • Human astrologer consultations (via independent contractors)
  • Personalized astrological readings and predictions
  • Birth chart generation and analysis
  • Horoscope content and astrological guidance

5. AI SERVICES AND LIMITATIONS

AI-Generated Content Disclosure: Certain Services on the Platform are powered by artificial intelligence technology. When you interact with an AI Astrologer, you will be clearly notified before the consultation begins that you are engaging with an AI-powered service and not a Human Astrologer.

AI Limitations: You acknowledge and understand that:

  • AI-generated astrological content is produced through automated, algorithmic systems and processes and may be subject to inherent limitations, biases, omissions or inaccuracies.
  • AI Astrologers cannot replicate human judgment, intuition, or personalized understanding of complex emotional or personal situations.
  • The accuracy, completeness, and reliability of AI-generated predictions and guidance cannot be guaranteed.
  • AI systems learn from data and user interactions, but such learning does not constitute professional expertise or human empathy.

Atri makes no representations or warranties, express or implied, regarding the accuracy, completeness, reliability, suitability, or timeliness of any AI-generated content. Any reliance on such content is solely at your own risk.

Algorithmic Transparency: While we strive for transparency, the specific algorithms, models, and data sources used by our AI systems are proprietary and confidential. However, we confirm that AI-generated content is for informational, entertainment and general guidance purposes only and should not be construed as factual, definitive or determinative advice of any nature.

6. ACCOUNT REGISTRATION AND SECURITY

Account Creation: To access certain features of the Platform, you may be required to create an account. You must meet the age and eligibility criteria as set out in Clause 3 of the Terms to create an account on the Platform. You may create an account using your mobile number, email id or social media handles. A one time password may be sent to you to verify your phone number or email id. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated at all times.

Account Security: You are responsible for maintaining the confidentiality of your account login credentials (username and password) and for all activity that occurs under your account. You agree to:

  • Use a strong and secure password
  • Immediately notify us of any unauthorized use of your account or any other breach of security
  • Ensure that you log out from your account at the end of each session

Personal Use Only: You agree that you will use your account on the Platform to make purchases only for personal, non-commercial use and not for business purposes or resale. You agree that you shall not share your account credentials with any third party for their use. You further acknowledge that use of another User's account information for availing services is strictly prohibited.

Account Suspension: We reserve the right to suspend or terminate your account if you provide false, incomplete, or misleading information, or if we have reason to believe that your account is being used in violation of these Terms.

7. PAYMENT TERMS AND BILLING

Pricing: Certain Services on the Platform may require payment. All prices are displayed in Indian Rupees (INR) unless otherwise specified and include applicable taxes as required by applicable laws.

If you are located in the European Union: (a) You have the right to withdraw within 14 days of purchase. However, by accessing digital services immediately, you: (a) consent to immediate performance; and (b) acknowledge that you may lose the right of withdrawal once the service has been fully provided.

Payment Methods: We accept payment through authorized payment gateways and methods as indicated on the Platform (including without limitation debit, credit cards, UPI, internet banking, etc.). By providing payment information, you authorize us to charge the applicable fees to your chosen payment method. You agree and understand that your personal data including without limitation to details relating to debit card/ credit card transmitted over the Internet may be susceptible to misuse, hacking, theft and/ or fraud and that the Platform or the Payment Service Provider(s) have no control over such matters.

Subscriptions: If you purchase a Subscription:

  • Your Subscription will automatically renew at the end of each billing cycle (monthly, quarterly, or annually as selected) unless you cancel before the renewal date.
  • You expressly authorize us (or our authorised payment processors) to charge the applicable subscription fee, including any renewal charges to your designated payment method on a recurring basis, without requiring further authorisation until such time till you cancel the subscription plan.
  • All Subscription fees shall be billed in advance at the beginning of each applicable billing cycle and are non-refundable, unless otherwise expressly set out in the Terms.
  • We reserve the right to revise the Subscription Fees at our sole discretion. Any changes shall be communicated to you with reasonable prior notice and shall become effective from the next billing cycle. Your continued use of the Subscription following such notice shall constitute your acceptance of the revised fees.
  • Pricing, billing frequency, and renewal terms will be clearly disclosed prior to purchase.

Free Trials: We reserve the right to offer free trial periods for certain Subscriptions on such terms and conditions as determined by us at our sole discretion. A user shall only be entitled to avail free trial offered by us once. At the end of the free trial period, your payment method will be automatically charged without any further authorisation unless you cancel before the trial period ends.

Taxes: You are responsible for all applicable taxes, including GST (Goods and Services Tax), associated with your purchase. Taxes will be calculated and added to your invoice as required by Indian tax laws.

Payment Failures: You are solely responsible for ensuring that your payment details are accurate and up to date. If your payment method fails or your account is past due, we may suspend or terminate your access to paid Services until payment is received.

Refund Policy:

  • Consultations: Fees paid for completed astrology consultations are generally non-refundable. However, if a technical error prevents the delivery of a paid consultation, we will provide a refund or credit to your account.
  • Subscriptions: Subscription fees are non-refundable except as required by applicable consumer protection laws. If you cancel your Subscription, you will retain access to paid features until the end of your current billing period, but no refund will be provided for the unused portion.
  • Company-Initiated Termination: If we terminate your account for reasons other than your breach of these Terms, we will provide a pro-rata refund for any prepaid Subscription fees for the unused portion of the subscription period.
  • Statutory Rights: Nothing in this refund policy affects your statutory rights under the Consumer Protection Act, 2019 or other applicable consumer protection laws.

Nothing in this refund policy limits or excludes any rights you may have under applicable consumer protection laws, including those applicable in the European Union, United Kingdom, United States, or Canada.

Cancellation: You may cancel your Subscription at any time through your account settings or by contacting customer support. Cancellation will be effective at the end of your current billing period.

8. DATA PROTECTION AND PRIVACY

Privacy Policy: Your use of the Platform is subject to our Privacy Policy, which explains how we collect, use, store, and protect your Personal Data. Please review our Privacy Policy carefully.

Compliance with DPDP Act: We are committed to complying with the Digital Personal Data Protection Act, 2023 ("DPDP Act") and all applicable data protection laws in India. We process your Personal Data only for specified, lawful purposes and in accordance with the principles of data minimization and purpose limitation. For users located outside India, additional rights and protections may apply as set out in Section 8A (International Data Protection Compliance).

Sensitive Personal Data: The Services may require you to provide sensitive Personal Data, including but not limited to:

  • Date, time, and place of birth
  • Personal questions and concerns
  • Location data
  • Financial information (for payment processing)

We will process such data only with your explicit consent and in accordance with applicable laws.

Your Rights: Under the DPDP Act and applicable laws, you have the right to:

  • Access your Personal Data
  • Correct or update inaccurate Personal Data
  • Request erasure of your Personal Data (subject to legal obligations)
  • Withdraw consent for data processing (where consent is the legal basis)
  • Lodge a complaint with the Data Protection Board of India

To exercise these rights, please contact our Grievance Officer using the details provided in Section 16.

Data Retention: We retain your Personal Data only for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. Upon account deletion, we will delete or anonymize your Personal Data within a reasonable timeframe, except where retention is required by law.

Cross-Border Transfers: If your Personal Data is transferred outside India, we will ensure appropriate safeguards are in place as required under the DPDP Act.

9. USER OBLIGATIONS AND PROHIBITED ACTIVITIES

When using the Platform, you agree not to:

  • Provide true, accurate, and current information
  • Violate any applicable laws, regulations, or these Terms of Use
  • Infringe upon the intellectual property rights of Atri or any third party
  • Transmit any harmful content, including viruses, malware, or other malicious code
  • Interfere with, disrupt, or impose an unreasonable burden on the Platform, servers, or networks connected to the Platform
  • Attempt to gain unauthorized access to the Platform, user accounts, or any related systems or networks through hacking, password mining, or any other means
  • Use automated systems (bots, scrapers, crawlers) to access or collect data from the Platform without our express written permission
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
  • Post or transmit any unlawful, threatening, abusive, defamatory, obscene, or otherwise objectionable content
  • Harass, abuse, or harm another person, including astrologers providing Services on the Platform
  • Use the Platform for any commercial purpose or resale without our express written consent
  • Attempt to reverse engineer, decompile, or disassemble any software or technology underlying the Platform
  • Remove, obscure, or alter any proprietary notices (copyright, trademark, etc.) on the Platform

Enforcement: We reserve the right to investigate and take appropriate legal action against anyone who violates these prohibitions, including removing User Content, suspending or terminating accounts, and reporting violations to law enforcement authorities.

10. USER CONTENT

Responsibility: You are solely responsible for any User Content that you post or submit to the Platform. You represent and warrant that:

  • You own all rights to your User Content or have obtained all necessary licenses, permissions, and consents to provide the User Content to the Platform
  • Your User Content does not violate any applicable laws or infringe upon the rights of any third party
  • Your User Content does not contain any confidential or proprietary information of third parties

License Grant: By posting or submitting User Content to the Platform, you grant Atri a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, and display your User Content solely for the purposes of:

  • Providing and operating the Platform and Services
  • Improving the Platform and Services (including training AI models)
  • Responding to your queries and providing customer support

License Limitations: The license granted above:

  • Does not grant us the right to sell or commercially exploit your User Content independently of the Services
  • Does not permit us to use your sensitive Personal Data (birth details, personal questions, consultation history) for marketing or promotional purposes without your separate express consent
  • Will terminate upon deletion of your User Content or closure of your account, except where we are required to retain data for legal compliance purposes

Content Moderation: We reserve the right (but have no obligation) to monitor, review, and remove User Content that violates these Terms or is otherwise objectionable. We may also remove User Content if required by law or upon receiving a valid legal complaint.

No Confidentiality: We do not guarantee confidentiality of any User Content that you post in public areas of the Platform (such as forums or public comments). For confidential consultations, please use private consultation features.

11. INTELLECTUAL PROPERTY RIGHTS

Ownership: The Platform and all content (excluding User Content and content provided by Human Astrologers) therein, including but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, software, AI models, algorithms, and user interfaces, are the exclusive property of Atri or its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws of India and international treaties.

Trademarks: "Atri" and all related logos, product and service names, designs, and slogans are trademarks of AtriAiApps Technologies Private Limited. You may not use such marks without our prior written permission.

Limited License: Atri grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for your personal, non-commercial use, subject to these Terms. This license does not include:

  • Any resale or commercial use of the Platform or its Content
  • Any collection, use, or copying of product listings, descriptions, or prices
  • Any derivative use of the Platform or its Content
  • Any downloading or copying of account information for the benefit of another user or third party
  • Any use of data mining, robots, scrapers, or similar data gathering and extraction tools

Restrictions: You may not:

  • Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the Platform
  • Frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or forms) of Atri without our express written consent
  • Use meta tags or any other "hidden text" utilizing Atri's name or trademarks without our express written consent
  • Circumvent, disable, or interfere with security-related features of the Platform or features that prevent or restrict use or copying of any Content

12. ENHANCED DISCLAIMERS

ENTERTAINMENT PURPOSES ONLY: ALL ASTROLOGY SERVICES PROVIDED ON THE PLATFORM, WHETHER BY AI ASTROLOGERS OR HUMAN ASTROLOGERS, ARE FOR INFORMATION, ENTERTAINMENT AND GENERAL GUIDANCE PURPOSES ONLY.

NOT PROFESSIONAL ADVICE: THE SERVICES DO NOT CONSTITUTE AND SHOULD NOT BE RELIED UPON AS:

  • Medical, psychiatric, psychological, or mental health advice, diagnosis, or treatment
  • Financial, investment, tax, or accounting advice
  • Legal advice or legal counseling
  • Professional counseling or therapy
  • Emergency services or crisis intervention

WARNING AGAINST SOLE RELIANCE:

AI ASTROLOGERS DO NOT PROVIDE, AND ARE NOT CAPABLE OF PROVIDING, MEDICAL, PSYCHOLOGICAL, FINANCIAL, LEGAL, OR ANY OTHER PROFESSIONAL ADVICE. YOU SHOULD NOT RELY ON AI-GENERATED CONTENT FOR MAKING CRITICAL LIFE DECISIONS RELATING TO PERSONAL, PROFESSIONAL PSYCHIATRIC, FINANCIAL OR LEGAL OR HEALTH RELATED NATURES AND YOU SHALL REMAIN SOLELY RESPONSIBLE FOR SEEKING APPROPRIATE ADVICE FROM QUALIFIED PROFESSIONALS WHERE REQUIRED.

YOU SHOULD NOT MAKE ANY MAJOR LIFE DECISIONS (INCLUDING BUT NOT LIMITED TO DECISIONS REGARDING HEALTH, FINANCES, RELATIONSHIPS, CAREER, OR LEGAL MATTERS) BASED SOLELY ON ASTROLOGICAL GUIDANCE OBTAINED THROUGH THE PLATFORM. ALWAYS CONSULT QUALIFIED PROFESSIONALS FOR SPECIFIC ADVICE TAILORED TO YOUR CIRCUMSTANCES.

YOU AGREE AND ACKNOWLEDGE THAT ANY ACTION TAKEN BASED ON AI-GENERATED CONTENT OR AI ASTROLOGERS ARE UNDERTAKEN AT YOUR SOLE DISCRETION AND RISK. ATRI SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE OR CONSEQUENCES ARISING OUT OF OR IN CONNECTION WITH YOUR RELIANCE ON AI ASTROLOGER AND AI CONTENT.

Prohibition on Medical Diagnoses: Astrologers (both AI and human) are strictly prohibited from:

  • Providing medical diagnoses or treatment recommendations
  • Advising users to discontinue medical treatment or prescribed medications
  • Claiming to cure or treat any medical condition through astrological guidance

If an astrologer violates this prohibition, please report it immediately to our Grievance Officer.

Full Disclosure Required: For your safety and to enable informed guidance, you are required to make full disclosure about the emotional, mental, and physical state of the person seeking advice from astrologers (both AI Astrologers and Human Astrologers) on the Platform. However, you acknowledge that such disclosure does not transform the Services into professional medical or psychological advice. Atri is not and shall not be responsible for any consequences or results of actions or inactions undertaken by You on the guidance provided to you by the astrologers on the Platform.

Astrologer Services Disclaimer: The astrologers listed on the Platform include both Human Astrologers (who are independent contractors) and AI Astrologers. Neither Human Astrologers nor AI Astrologers are employees or agents of Atri. We do not control, vet, or guarantee the accuracy, completeness, reliability, or usefulness of any information, advice, guidance, or recommendations provided by astrologers. Any views expressed by an astrologer are solely the views of that astrologer and do not represent the views of Atri.

13. LIMITATION OF LIABILITY

As-Is Basis: The Platform and all Services are provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, unless otherwise specified in writing.

Disclaimer of Warranties: To the fullest extent permitted by applicable law, Atri disclaims all warranties, express or implied, including but not limited to:

  • Implied warranties of merchantability and fitness for a particular purpose
  • Warranties regarding accuracy, reliability, completeness, or timeliness of Content or Services
  • Warranties that the Platform will be uninterrupted, secure, or error-free
  • Warranties that the Platform, servers, or electronic communications are free of viruses or other harmful components

Subject to Consumer Protection Laws: The foregoing disclaimers are subject to applicable consumer protection laws, including the Consumer Protection Act, 2019. Nothing in these Terms excludes or limits our liability for:

  • Gross negligence or willful misconduct
  • Fraud or fraudulent misrepresentation
  • Death or personal injury caused by our negligence
  • Any liability that cannot be excluded or limited under applicable law

Limitation of Liability: To the maximum extent permitted by applicable law, in no event shall Atri, its affiliates, officers, directors, employees, agents, or licensors be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Loss arising from your reliance on astrological guidance or predictions
  • Damages arising from unauthorized access to or alteration of your data or transmissions
  • Damages arising from any third-party content or conduct on the Platform

Even if we have been advised of the possibility of such damages.

Liability Cap: In any event, our total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the Platform shall not exceed the amount you paid to Atri in the twelve (12) months preceding the claim, or INR 10,000, whichever is lower.

AI-Specific Limitations: We specifically disclaim liability for any errors, inaccuracies, biases, or harmful outputs generated by AI Astrologers. AI-generated content is provided without any guarantee of accuracy or suitability for your specific circumstances.

Nothing in these Terms excludes or limits liability: for death or personal injury caused by negligence (where applicable); for fraud or fraudulent misrepresentation; or where such limitation is prohibited under applicable consumer protection laws.

14. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Atri, our subsidiaries, affiliates, licensors, and their respective officers, directors, employees, agents, partners, and representatives from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees and legal costs) arising out of or related to:

  • Your use or misuse of the Platform or Services
  • Your violation of these Terms of Use
  • Your violation of any rights of another person or entity, including intellectual property rights
  • Your User Content
  • Your violation of any applicable laws or regulations
  • Any decisions you make based on astrological guidance obtained through the Platform

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of such claim.

15. THIRD-PARTY SERVICES AND INTEGRATIONS

Third-Party Links: The Platform may include links to third-party websites, applications, or services that are not owned or controlled by Atri. We have no control over, and assume no responsibility for, the content, privacy policies, terms of use, or practices of any third-party websites or services.

Payment Gateways: We use third-party payment processors to facilitate transactions on the Platform. Your payment information is subject to the privacy policies and terms of use of such payment processors. We do not store your complete credit card or debit card information on our servers.

Analytics and Tracking: We may use third-party analytics services (such as Google Analytics) to analyze usage patterns and improve the Platform. These services may collect information about your use of the Platform in accordance with their own privacy policies.

Social Media Integration: The Platform may allow you to connect your social media accounts or share content on social media platforms. Your use of such features is governed by the privacy policies and terms of use of the respective social media platforms.

User Consent: By using third-party integrations on the Platform, you consent to the sharing of your information with such third parties as necessary to provide the integrated services, subject to our Privacy Policy.

16. GRIEVANCE REDRESSAL MECHANISM

In accordance with the Information Technology Act, 2000 and the Consumer Protection (E-Commerce) Rules, 2020, we have appointed a Grievance Officer to address your concerns and complaints.

Complaint Process:

  • You may submit complaints or grievances to the Grievance Officer via email or through the complaint form on the Platform.
  • We will acknowledge receipt of your complaint within 24 hours.
  • We will investigate and respond to your complaint within 15 (fifteen) business days from the date of receipt.
  • If your complaint relates to content takedown or violation of applicable laws, we will address it within the timelines prescribed under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

Escalation: If you are not satisfied with the resolution provided by the Grievance Officer, you may escalate the matter to the appropriate consumer forum or regulatory authority.

18. ADVERTISING STANDARDS COMPLIANCE

We are committed to complying with the Advertising Standards Council of India (ASCI) guidelines and the ASCI Guidelines for Astrology and Related Services. Accordingly:

  • We do not make misleading claims or guarantees about the accuracy of predictions or the certainty of future events.
  • We clearly disclose that astrology services are for entertainment and general guidance purposes.
  • We do not advertise astrology services as a substitute for professional medical, financial, or legal advice.
  • We ensure that all advertising and promotional content is truthful, not deceptive, and complies with applicable advertising laws.
  • We clearly disclose any paid content, sponsored content, or endorsements as required by law.

19. TERMINATION

Termination by Atri: We may suspend or terminate your access to the Platform immediately, with or without prior notice, if:

  • Your provision of any incomplete, untrue or misleading information
  • You breach any provision of these Terms of Use
  • We are required to do so by law or regulatory authority
  • We suspect fraudulent, abusive, or illegal activity on your account
  • Your account has been inactive for an extended period

However, for material breaches that are capable of being remedied, we will provide you with notice and a reasonable opportunity to cure the breach before terminating your account, unless immediate termination is required to protect our rights or the rights of other users.

Termination by You: You may terminate your account and discontinue use of the Platform at any time by:

  • Following the account deletion process in your account settings, or
  • Contacting our customer support team

If you have an active Subscription, termination will be effective at the end of your current billing period unless you request immediate termination (in which case no refund will be provided for the unused portion).

Effect of Termination: Upon termination:

  • Your right to access and use the Platform will cease immediately
  • We will delete or anonymize your Personal Data within a reasonable timeframe, except where retention is required for legal compliance, dispute resolution, or enforcement of these Terms
  • You will remain liable for all amounts due under these Terms prior to termination
  • Sections of these Terms that by their nature should survive termination (including but not limited to Sections 11, 13, 14, 20, and 21) will continue to apply

Refund Upon Company-Initiated Termination: If we terminate your account for reasons other than your breach of these Terms, and you have a prepaid Subscription, we will provide a pro-rata refund for the unused portion of your subscription period.

Nothing in this section limits any mandatory consumer rights under applicable law, including refund or cancellation rights available under EU, UK, US, or Canadian consumer protection laws.

Data Portability and Deletion: Upon termination, you may request a copy of your Personal Data (subject to technical feasibility and legal requirements). You may also request deletion of your Personal Data, except where we are required to retain it for legal or regulatory purposes.

20. TERRITORIAL USE

The Platform may not be available in all jurisdictions. You hereby acknowledge and agree that certain features or Services may not be available in all jurisdictions. You are responsible for compliance with local laws applicable to your use of the Platform.

21. DISPUTE RESOLUTION AND ARBITRATION

Informal Resolution: Before initiating formal dispute resolution, you agree to first contact us to attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform ("Dispute") informally. Please contact our Grievance Officer with a detailed description of the Dispute. We will make good faith efforts to resolve the Dispute within 30 (thirty) days.

Arbitration: If the Dispute cannot be resolved informally within 30 days, either party may initiate binding arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended, subject to the following:

  • Seat and Venue: The seat of arbitration shall be Bangalore, India.
  • Language: The arbitration proceedings shall be conducted in English.
  • Number of Arbitrators: For Disputes involving claims of INR 10,00,000 (Ten Lakh Rupees) or less, the arbitration shall be conducted by a sole arbitrator mutually appointed by the parties. For Disputes involving claims exceeding INR 10,00,000, the arbitration shall be conducted by a panel of three arbitrators.
  • Governing Rules: The arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996.
  • Costs: Each party shall bear its own costs of arbitration, unless the arbitral tribunal awards costs to the prevailing party.

Exception for Consumer Claims: Notwithstanding the arbitration provision above, if you are a consumer and your claim qualifies for resolution under the Consumer Protection Act, 2019, you may opt out of arbitration and file your complaint with the appropriate Consumer Commission (District, State, or National) or any other forum having jurisdiction, as provided under applicable consumer protection laws.

Small Claims Exception: Either party may elect to have Disputes involving claims below INR 50,000 (Fifty Thousand Rupees) resolved in a court of competent jurisdiction, notwithstanding the arbitration provision.

Injunctive Relief: Notwithstanding the foregoing, either party may seek interim or injunctive relief in a court of competent jurisdiction to protect its intellectual property rights or confidential information.

Class Action Waiver: To the extent permitted by applicable law, you agree that: disputes shall be resolved on an individual basis only; and you waive the right to participate in any class, collective, or representative action.

22. GOVERNING LAW AND JURISDICTION

These Terms of Use and your use of the Platform shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Subject to the arbitration and dispute resolution provisions in Section 21, any legal action or proceeding arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts located in Bangalore, India.

Venue Clarification: For purposes of these Terms, our registered office is located in Bangalore, India, and all legal notices, service of process, and jurisdictional matters shall reference Bangalore as the appropriate venue.

23. MODIFICATION OF TERMS

Right to Modify: We reserve the right to modify, amend, or update these Terms of Use at any time in our sole discretion.

Notice of Changes: We will provide notice of material changes to these Terms by:

  • Posting the revised Terms on the Platform with an updated "Last Updated" date
  • Sending an email notification to the email address associated with your account (if you have an account), and/or
  • Displaying a prominent notice/in-app notifications or push notifications on the Platform

We will provide such notice at least 15 (fifteen) days before the effective date of material changes, except where changes are required by law or are necessary to address security or legal concerns, in which case changes may be effective immediately.

Acceptance of Changes: Your continued use of the Platform after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Platform and may terminate your account as provided in Section 19.

Right to Reject Changes: If you do not agree to material changes to these Terms, you have the right to terminate your account before the effective date of the changes. If you have a prepaid Subscription and you terminate due to material changes to these Terms that adversely affect your rights, we will provide a pro-rata refund for the unused portion of your subscription period.

24. FORCE MAJEURE

Atri shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay is due to causes beyond its reasonable control, including but not limited to:

  • Acts of God, natural disasters, pandemics, epidemics, or public health emergencies
  • War, terrorism, civil unrest, or acts of government or regulatory authorities
  • Strikes, labor disputes, or shortages of labor or materials
  • Failures of telecommunications, internet service providers, or hosting providers
  • Power outages, equipment failures, or technical malfunctions beyond our reasonable control
  • Cyberattacks, hacking, or other security incidents affecting our systems or third-party services
  • Changes in laws or regulations that prevent or restrict our ability to provide the Services

In the event of a force majeure event, we will make reasonable efforts to notify users and to resume normal operations as soon as practicable.

25. ASSIGNMENT

No Assignment by You: You may not assign, transfer, or delegate these Terms or your rights and obligations hereunder, in whole or in part, without our prior written consent. Any attempted assignment in violation of this provision shall be null and void.

Assignment by Atri: We may assign, transfer, or delegate these Terms and our rights and obligations hereunder, in whole or in part, without your consent, including in connection with a merger, acquisition, corporate reorganization, sale of assets, or by operation of law.

26. NOTICES

Notice to You: We may provide notices to you by:

  • Posting notices on the Platform
  • Sending an email to the email address associated with your account
  • Sending a push notification through the Platform (if you have enabled notifications)
  • Sending postal mail to the address you have provided (if applicable)

Notices sent by email or push notification shall be deemed delivered 24 hours after sending. Notices posted on the Platform shall be deemed delivered upon posting.

Notice to Atri: You may provide notices to us by:

  • Sending an email to the contact address provided in Section 30
  • Sending postal mail to our registered office address provided in Section 30

Notices to Atri shall be deemed delivered when actually received by us.

27. ENTIRE AGREEMENT

These Terms of Use, together with our Privacy Policy and any other legal notices or agreements published by us on the Platform, constitute the entire agreement and understanding between you and Atri concerning your use of the Platform and supersede any prior or contemporaneous communications, agreements, or understandings, whether oral or written, between you and Atri regarding the subject matter hereof.

28. SEVERABILITY

If any provision of these Terms of Use is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent, or if such modification is not possible, such provision shall be severed from these Terms. The remaining provisions of these Terms shall remain in full force and effect.

29. WAIVER

Our failure to enforce any right or provision of these Terms of Use shall not be deemed a waiver of such right or provision. No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any waiver must be in writing and signed by an authorized representative of Atri.
